BOOKING TERMS & CONDITIONS


1. Definitions

In these Booking Terms & Conditions:

  • “you”, “traveller”, “client”, “customer” means the person making the booking and all persons included in that booking.
  • “we”, “our”, “us” refers to Muhammadiyah Tours Ltd, trading as Muhammadiyah Tours.


2. Our Services

We are a UK-registered ground-only tour operator providing land-based travel services. These may include accommodation, local transport, ground transfers, guided tours, and related travel services.

We do not sell, arrange, or include flights as part of any booking. All flights are booked independently by customers and do not form part of any contract with us.

Where customers arrange their own flights, it is their responsibility to ensure flight timings align with the start and end of the land arrangements booked with us. We cannot accept responsibility for missed services resulting from flight delays, cancellations, or schedule changes.


3. Accuracy of Information

We take reasonable care to ensure that information and pricing published on our website, promotional materials, and booking confirmations is accurate at the time of publication. However, errors may occasionally occur.

If a correction is required, we reserve the right to amend details and pricing. You will be informed promptly of any material changes and offered appropriate options. You must check your booking confirmation carefully and notify us immediately of any discrepancies.


4. Travel Insurance

Comprehensive travel insurance is a mandatory condition of booking. Your insurance policy must include cover for:

  • cancellation or curtailment,
  • medical expenses, and
  • repatriation.

If you travel without adequate insurance, we will not be liable for any losses that would otherwise have been covered by an appropriate policy.


5. Passports, Visas & Entry Requirements

Unless expressly agreed in writing, you are responsible for ensuring that you hold a valid passport and obtain all necessary visas and travel documentation.

Any assistance provided with visa processing is administrative only, and related service fees are non-refundable. We are not responsible for refusal of entry, fines, or costs arising from failure to meet entry requirements.


6. Pricing & Payment

Prices are based on exchange rates and supplier costs at the time of quotation and may change prior to booking confirmation.

Full payment is required no later than 30 days before departure, or 6 weeks before departure for Umrah packages, unless otherwise stated on your invoice or booking confirmation.

Failure to pay on time may result in cancellation of your booking and the application of cancellation charges.


7. Amendments by You

Requests to amend bookings after confirmation must be made in writing (to email info@muhammadiyah.tours). Amendments are subject to availability and supplier terms. Any additional costs or administration fees must be paid by you.


8. Transfer of Booking

You may transfer your booking to another person who satisfies all booking requirements, provided that:

  • written notice is received at least 7 days before departure, and
  • all costs incurred in making the transfer are paid.

Both you and the replacement traveller will be jointly responsible for payment.


9. Cancellation by You

If you wish to cancel your booking, you must notify us in writing.                                                                                                                              Cancellation charges apply as follows:

10. Refunds & Non-Refundable Charges

Administration fees, visa handling fees, amendment charges, and supplier deposits may be non-refundable.

Once a visa has been issued, no refunds will be given. If your travel insurance policy covers cancellation, you may be able to claim directly from your insurer.


11. Changes or Cancellation by Us

If we are required to make significant changes to your arrangements, you will be offered the choice of:

a) accepting the change,
b) accepting an alternative arrangement (if available), or
c) receiving a refund of monies paid.


12. Force Majeure

We cannot accept liability for events beyond our reasonable control, including (but not limited to) natural disasters, war, terrorism, epidemics, strikes, government restrictions, or adverse weather conditions.

Such events may require changes to or cancellation of arrangements without liability.


13. Local Services Booked Independently

Any services or excursions booked locally or independently, and not arranged in advance by us, do not form part of your contract with us and remain your responsibility.


14. Assistance During Travel

If you experience difficulties during your trip, you must notify us or our local representative as soon as reasonably possible. We will provide reasonable assistance and advice where appropriate.

We may charge a reasonable fee for assistance where difficulties arise due to your negligence or deliberate actions.


15. Duty of Care (Ours and Yours)

Our Duty of Care

We owe you a duty of care to exercise reasonable skill and care in organising the land-based services that form part of your booking. This includes selecting reputable accommodation providers, transport operators, guides, and suppliers, and taking reasonable steps to ensure services are delivered as described and in accordance with applicable local laws and safety standards.

Our duty of care does not extend to circumstances beyond our reasonable control, to services not arranged by us, or to the acts or omissions of third parties over whom we have no direct control.


Your Duty of Care

You owe a duty of care to yourself and to others in your travel group. This includes acting responsibly, complying with local laws and customs, following safety instructions, and ensuring you are medically fit to travel.

Failure to act reasonably or to follow safety guidance may limit or exclude our liability where permitted by law.


16. Special Requests & Medical Conditions

Special requests must be submitted in writing at the time of booking. While we will pass these requests to suppliers, fulfilment cannot be guaranteed.

You must inform us before booking of any medical conditions, disabilities, or reduced mobility that could affect your travel.


17. Behaviour

You are expected to behave responsibly and respectfully at all times. If your conduct causes danger, distress, or damage, we reserve the right to terminate your arrangements immediately without refund. You will be responsible for any resulting costs or damages.


18. Unused Services

No refunds will be made for unused services, no-shows, or early termination of travel arrangements after departure.


19. Luggage & Personal Property

You are responsible for your luggage, personal belongings, and travel documents at all times. We cannot accept liability for loss, theft, or damage unless caused by our negligence.


20. Timekeeping

Punctuality is essential. Failure to arrive on time for departures, transfers, or activities may result in missed services. No refunds will be given, and any additional costs will be your responsibility.


21. Transport & Seating

Where transport is provided, you must comply with vehicle and seating allocations. Drivers and staff may not be instructed to alter routes or schedules. Failure to comply may result in additional costs for which you will be responsible.


22. Data Protection (UK GDPR)

We collect and process personal data in accordance with the UK General Data Protection Regulation (UK GDPR). Data is used solely for booking administration, legal compliance, and service delivery, and is shared only with suppliers where necessary.

23. Customer Money Protection

Where a booking constitutes a package under the Package Travel and Linked Travel Arrangements Regulations 2018, customer monies are protected through supplier failure insurance, in accordance with UK law.


24. Liability

Our liability is limited to the services we directly provide. Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence.


25. Governing Law

These Booking Terms & Conditions are governed by English law, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
